Q: Hi, my husbands runs a small business as a contractor to a number of builders and developers and I do the books, He has had to bring on subcontractors to complete the work on time and we want to check about how we pay them, do they need a ABN, do we pay GST on their invoices, what about super, our accountant is away so any help would be great?
A: Hi Sophie,

Yes anyone performing services (if not an employee) must have an ABN number. The contractors are only required to registered for GST once their turnover reaches or is likely to reach $75,000 per annum. The Australia Business Register https://abr.gov.au, has a lookup tool you can use to check if a an entity is registered for GST or not.

There are many aspects to consider when utilising a contractor for building services for example insurance do they have their own liability insurance(s) or workers compensation cover or is that something you need to provide.

Superannuation, is the contractor an independant contract or deemed to be an employee for superannuation purposes. The ATO has specific tools available to help you decide.

Do you have to provide a TPAR (Taxbale Payments Annual Report) to the ATO.

If you would like to discuss your specific scenario further then please give us a call.

Thanks

Q: Hi there, over the past 12 months our business has grown from just my husband and I to 7 staff and keeping track of salaries, payroll tax, the insurances and super is not a part of our skill set. We really need help but don’t want to put on anyone full time.

Does anyone know of a bookkeeper that can handle all of this or are we better off going through a payroll agency, any recommendation would be helpful?
A: Hi Kerry-Anne,

Just following up on our exchange a couple of weeks ago.

As a small business owner you will need to prepare Payment Summaries and lodge Annual Payment Reports with the ATO.

Give me a call soon so we can make sure you are ready to meet these obligations.

Look forward to chatting soon.

Thanks

Q: I have two ABNs - a sole trader and a company. Same business, one followed the other. Do invoices issued under the first ABN have to be accounted for in the BAS for that entity, or can they be shifted to the company BAS if paid after it was set up?
A: Hi Todd, the ABN and the GST relate to a specific entity. So in the scenarios you mentioned above any invoice issued with the sole trader ABN would have to be lodged for BAS purposes under the sole traders ABN.
There are many differences between your responsibility as a sole trader and that of a company. The ATO has a lot of information that may assist you further. www.business.gov.au then search key differences between sole traders and companies.
I hope you find this information useful.
